Terms of Service

These Terms of Service ("Terms") govern your use of OrderCome (the "Service") operated by Sample Company ("we," "us," or "our"). By using the Service, you agree to these Terms.

Article 1 — Definitions

  • "User" means a business operator (restaurant owner or manager) who has registered an account.
  • "End User" means a customer of the User who interacts with the QR ordering feature.
  • "Service" means the QR code self-ordering system "OrderCome" provided by us.

Article 2 — Eligibility

The Service is intended for food and beverage businesses. The following parties may not use the Service:

  • Anyone previously suspended or terminated by us
  • Any person or entity affiliated with organized crime
  • Anyone we determine to be inappropriate at our discretion

Article 3 — Account Registration

  • You must provide accurate information when registering.
  • You may not transfer, lend, or share your account (except through our authorized team member feature).
  • You are responsible for keeping your credentials secure.

Article 4 — Fees and Payment

  • Payments are processed automatically via credit card.
  • Subscriptions renew monthly; the next month's fee is charged on the renewal date.
  • We may change pricing with 30 days' notice. Continued use after the change constitutes acceptance.

Article 5 — Free Trial

  • New paid plan subscribers receive a 7-day free trial.
  • No charge applies if you cancel before the trial ends.
  • After the trial, you are automatically moved to the paid plan.
  • The free trial is available once per user.

Article 6 — Cancellation

  • You may cancel at any time from your account settings.
  • You retain access through the end of the current billing period.
  • Partial-month refunds are not provided upon cancellation.

Article 7 — Prohibited Conduct

  • Violating any applicable laws or these Terms
  • Infringing the intellectual property, privacy, or reputation of us or any third party
  • Attempting unauthorized access to or reverse engineering of the Service
  • Using the Service for spam or fraudulent activity
  • Reselling or sublicensing the Service without our prior written consent

Article 8 — Intellectual Property

All intellectual property rights in the Service belong to us. Content you upload (menus, store info, etc.) remains your property.

Article 9 — Service Changes and Outages

  • We may modify the Service with prior notice.
  • Temporary outages may occur for maintenance or due to technical issues.

Article 10 — Service Termination

  • If we discontinue the Service, we will notify you at least 60 days in advance.
  • A pro-rated refund will be issued for any unused portion of the billing period after termination.
  • Your data will remain available for download for 30 days after the termination date, after which it will be permanently deleted.

Article 11 — Limitation of Liability

  • We do not warrant that the Service will be error-free or uninterrupted.
  • Our total liability is limited to the fees you paid in the 3 months preceding the claim.
  • We are not responsible for disputes between you and your end users.

Article 12 — Privacy

Our handling of personal data is governed by our Privacy Policy.

Article 13 — Changes to These Terms

For significant changes, we will provide at least 30 days' notice. Continued use of the Service constitutes acceptance of the updated Terms.

Article 14 — Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court.
