Terms of Service

These Terms of Service ("Terms") govern your use of OrderCome (the "Service") operated by PEAKEAST ("we," "us," or "our"). By using the Service, you agree to these Terms.
Article 1 — Definitions
- "User" means a business operator (owner, manager, etc.) who has registered an account.
- "End User" means a customer of the User who interacts with the QR ordering feature.
- "Service" means the QR code self-ordering system "OrderCome" provided by us.
Article 2 — Eligibility
The Service is intended for food and beverage businesses. The following parties may not use the Service:
- Anyone previously suspended or terminated by us
- Any person or entity affiliated with organized crime or antisocial forces
- Anyone we determine to be inappropriate at our discretion
You represent and warrant that neither you nor any of your officers, employees, or other related parties are affiliated with organized crime or antisocial forces, and that this will remain true throughout your use of the Service.
Article 3 — Account Registration
- You must provide accurate information when registering.
- Your account becomes active upon email verification.
- You may not transfer, lend, or share your account (except through our authorized team member feature).
- You are responsible for keeping your credentials secure.
- By agreeing to these Terms, you consent to receive service notifications — such as pricing changes, Terms updates, and important security notices — at your registered email address.
Article 4 — Fees and Payment
- The Free plan is available indefinitely at no charge.
- Paid plan payments are processed automatically via credit card through Stripe.
- Subscriptions renew monthly; the next month's fee is charged on the renewal date.
- We may change pricing with 30 days' notice by a method we determine. Continued use after the change constitutes acceptance.
- Payments are processed by Stripe Inc., and payment-related matters are governed by Stripe's terms of service. We are not liable for any damages caused by failures or errors on Stripe's part.
- Paid plan fees are denominated in US dollars. The amount charged to your credit card may vary depending on the exchange rate at the time of billing. We are not responsible for any differences arising from exchange rate fluctuations.
Article 5 — Paid Plan Benefits
- New paid plan subscribers receive a 7-day free trial.
- No charge applies if you cancel before the trial ends.
- After the trial, you are automatically moved to the paid plan.
Article 6 — Cancellation and Account Deletion
Free Plan Users
- You may delete your account at any time from your account settings.
- Upon account deletion, all of your data — including menus, tables, and order history — will be permanently and immediately deleted. This action cannot be undone.
Paid Plan Users (coming soon)
- You may cancel your subscription at any time from your account settings.
- You retain access through the end of the current billing period.
- Partial-month refunds are not provided upon cancellation.
- No charge applies if you cancel during the 7-day free trial.
- All data will be permanently deleted within 30 days after the end of the final billing period.
Article 7 — Suspension and Account Termination
We may, without prior notice, restrict access, suspend, or delete an account if:
- The User violates these Terms
- The User registers false or misleading information
- The User's actions disrupt or interfere with the Service
- We otherwise determine the User's conduct to be inappropriate
We are not liable for any damages incurred by the User as a result of such measures.
Article 8 — Damages
If a User violates these Terms or causes damage to us through unauthorized use or other misconduct, we reserve the right to seek compensation for such damages from the User.
Article 9 — Prohibited Conduct
- Violating any applicable laws or these Terms
- Infringing the intellectual property, privacy, or reputation of us or any third party
- Attempting unauthorized access to or reverse engineering of the Service
- Using the Service for spam or fraudulent activity
- Reselling or sublicensing the Service without our prior written consent
- Registering false or misleading information
- Any other conduct we determine to be inappropriate
Article 10 — Intellectual Property
All intellectual property rights in the Service belong to us. Content you upload (menus, store info, etc.) remains your property.
By uploading content to the Service, you grant us a free, non-exclusive license to use such content to the extent necessary for the provision, operation, and maintenance of the Service.
Article 11 — Service Changes and Outages
- We may modify the Service's features, UI, or API specifications without your individual consent. Such changes may affect your day-to-day operations.
- For significant changes — such as pricing changes or removal of core features — we will provide at least 30 days' notice by a method we determine.
- Bug fixes, minor UI adjustments, and security updates may be applied without prior notice.
- Temporary outages may occur for maintenance or due to technical issues.
- In the event of an unavoidable suspension due to emergency security incidents, system failures, or other circumstances beyond our reasonable control, no refund will be issued for paid plan fees.
Article 12 — Beta Service
The Service is currently provided as a beta version.
- During the beta period, features may be added, changed, or removed without prior notice.
- While we make best efforts to protect your data, the nature of beta software means data loss or corruption may occur, and we cannot fully guarantee data integrity.
- You are responsible for maintaining your own backups of any data you consider important.
- We do not guarantee the stability or continuity of the Service during the beta period.
- The terms and conditions of the beta may change upon official release.
- Data registered during the beta period will in principle remain accessible after the official release.
Article 13 — Service Termination
- If we discontinue the Service, we will notify you at least 60 days in advance.
- Upon termination, we may, at our discretion, provide a refund for the unused portion of the billing period.
- Your data will remain available for download for 30 days after the termination date, after which it will be permanently deleted.
Article 14 — Limitation of Liability
- We do not warrant that the Service will be error-free, uninterrupted, or continuously available.
- We do not guarantee any specific level of uptime, response time, or service availability.
- Our total liability is limited to the fees you paid in the 3 months preceding the claim.
- We are not responsible for disputes between you and your end users.
- We are not liable for damages caused by events beyond our reasonable control, including but not limited to: natural disasters, earthquakes, typhoons, pandemics, failures of cloud infrastructure such as AWS, failures of third-party services such as Stripe, telecommunications failures, and internet outages.
Article 15 — Privacy
Our handling of personal data is governed by our Privacy Policy.
Article 16 — Changes to These Terms
For significant changes, we will provide at least 30 days' notice by a method we determine. Minor changes such as typo corrections or clarifications may be made without prior notice. Continued use of the Service constitutes acceptance of the updated Terms.
Article 17 — Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court.
